Remote Employees
If companies have employees that work 100% from home and never report to a headquarters or other location, hard copies of mandatory employment notices should be mailed to the employees homes, where they can be posted. Otherwise, if employees do report to a physical location some of the time, ensure that the appropriate notices are posted and visible in that particular location. Senate Bill 657 (SB 657) addresses electronic distribution of state required workplace postings; however, the new law doesn’t change the employers’ obligations to physically post required notices.
Employers are wondering if they can just email required notices to remote employees, and the answer is no.
Although SB657 may allow for the electronic distribution of notices via email, it doesn’t change the posting requirements, which is to physically display posters in the workplace. For remote workers, the physical posting requirement applies to the employee’s home. So, if an employer opts to send required notices to remote workers, the employer needs to direct the remote worker to print and post the notices, and the employer will need to reimburse for any expenses incurred by the employee to do so.
