SB 253 and SB 261 Lawsuit Chronology and Documents

On January 30, 2024, the California Chamber of Commerce announced that it has joined the U.S. Chamber of Commerce and other allied groups in bringing a lawsuit that challenges California’s new climate reporting laws—SB 253 (Wiener; D-San Francisco) and SB 261 (Stern; D-Canoga Park).

Filed in U.S. District Court for the Central District of California, Western Division, the lawsuit asserts that both SB 253 and SB 261 unconstitutionally compel speech in violation of the First Amendment and conflict with existing federal law and the Constitution’s delegation to Congress of the power to regulate interstate commerce. CalChamber is representing its member companies in the action, many of whom are subject to the new laws.

In addition to the U.S. Chamber and CalChamber, plaintiffs include American Farm Bureau Federation, Los Angeles County Business Federation, Central Valley Business Federation and Western Growers Association.
